You have access to and are aware of the criteria the Company uses to select the Website Physicians. The credentialing criteria may change from time to time and any change will be effective immediately upon posting the modified credentialing criteria on the Website. You are aware that, although the Company obtains credentialing information from its Website Physicians, the Company has not independently confirmed nor will it independently confirm the credentials of these Website Physicians. You understand that the Company does not have an affirmative duty to (i) monitor the licensing status of its Website Physicians or (ii) update their respective medical malpractice insurance coverage. You also understand that the Company, in its sole and absolute discretion, may remove the name of a physician from the Website at any time. You acknowledge that the removal of a physician's name from the Website does not mean the physician is unqualified or inept. 9. Relationship between the Company and the Website Physicians. None of the Website Physicians are employees, agents, representatives, partners or joint venturers of the Company. You understand that the Company does not assist the Website Physicians with their respective diagnosis or endorse any form of cancer treatment. You understand that the Company does not influence or direct the activities of these Website Physicians. The Website maintains lists of physicians for referral purposes only. Of the Website Physicians selected by the Company for your consideration, the Company does not recommend one physician over another. You understand that the names of the Website Physicians listed as possible referrals have been randomly chosen, with no preferences given to any one Website Physician. 10. Financial Arrangements. You understand that the Company does not receive any remuneration or payment from any Website Physician nor does the Company pay or compensate any of its Website Physicians. You are responsible for establishing your own financial arrangements with the Website Physician you select, and the Company will not be liable for any breach of such financial arrangements. 11. Response to Inquiries. You understand that, while the Website is an interactive website and will use its best efforts to respond to your inquiries, the Company cannot guarantee the day or time that the Company shall respond to your inquiries. The Company will use its best efforts to keep your name and medical history confidential. The Company utilizes codes and other non-descriptive means of storing and tracking user information. (c) No Guarantee of Privacy and Security Measures. You understand that the Company does not guarantee that its privacy and security measures will not be susceptible to computer viruses or to third parties who break into or corrupt the Company's database. You understand and agree that the Company does not guarantee or warrant against human and/or machine errors, omissions, delays, interruptions or losses of information or data, infringing material, or defamation. You also understand and agree that the Company does not guarantee or warrant that files available for downloading through the Website will be free of infection or viruses, worms, Trojan horses or other codes that manifest contaminating or destructive properties. (d) Access and Disposition of Personal Information. The Company will maintain your identity and medical history on its database for so long as you communicate directly with the Company. You may request access to the personal information the Company has on you. In any claim or action arising under this Agreement or related to the Website, you irrevocably submit to the exclusive personal jurisdiction of the Maryland state circuit court located in Montgomery County, Maryland, or if such court does not have subject matter jurisdiction, then you irrevocably submit to the exclusive personal jurisdiction of the United States Court for the District of Maryland. And whichever of the foregoing courts has jurisdiction, you waive any jurisdictional, venue or inconvenient forum objections to such court. 15. Trademarks; Copyrights. You understand and agree that any and all marks of the Company are owned by the Company and are protected against infringement by federal or common law. The materials provided through the Website are copyrighted by the respective party from which the materials originated. Those materials may only be downloaded and/or reprinted for personal use. (b) Entire Agreement; Modification. This Agreement constitutes the entire agreement between yourself and the Company. The Company may modify this Agreement from time to time and the modified Agreement will become effective upon its posting on the Website. Anything in the Website which is inconsistent or conflicts with the provisions of this Agreement is superseded by the provisions of this Agreement. 17. Paper Copy of this Agreement.
